In today’s episode Chuck talks about a recent change in policy in the Department of Justice to enforce federal marijuana laws which could impact marijuana legalization in states.

Hi friends.

Something newsworthy has happened – well there is always news going on – but this will affect a lot of my clients and a lot of my friends, good or bad.

A few weeks ago, the United State’s Attorney General Jeff Sessions announced that he was going to rescind Obama era instructions to the Department of Justice to stop enforcing federal law as it pertains to marijuana.

As you know, a lot of the states have allowed medicinal marijuana and now some states are going as far as recreational marijuana and the feds have backed off. It is still, regardless of state law, it is against federal marijuana laws to even possess marijuana. Let alone grow it, transport it, and sell it. So, the FBI and the DEA, through the department of justice have backed off for the last six, seven, or eight years.

Well, now the attorney general appointed by President Trump has decided that he is going to sort of move backward in time and start enforcing those laws. So they aren’t going to, at least I don’t think they are going to be enforced as far as somebody with small amounts, in terms of an ounce of pot or something but it is at some point going to affect you getting a prescription filled or being able to buy  your medicinal marijuana and in some states recreational marijuana, because it is going to be against federal marijuana laws.

It has always been against federal law. It is just a law that hasn’t been enforced in awhile.

I would really like to know what everyone’s opinion is on this. Again, we’ve had a law, congress hasn’t made any changes with the law since god knows when. For years it has been illegal to possess marijuana.

I would like to know if you are in favor of the feds going forward and enforce federal marijuana laws. If you are against it, then what you need to do is tell the Senators of your state which would be John McCain and Jeff Flake.  Or your congressman across the state of Arizona and let them know how you feel about this issue.

Because the only way that is going to be usurped, in other words getting around the Attorney General’s directive or the rescinding of  this directive is for congress to change laws relative to the state’s enacting their own marijuana laws relative to recreational use or medicinal use.

I’d really like to know what everyone’s opinion is on that, because it seems to be, at least when I have talked to people, most people seem to be discouraged about this new news. It’s almost as if we are moving back in time.
